The Bússola Dourada – Lda., headquartered at Rua São João Bosco, n.º 7, 9060-296 Santa Maria Maior, registered in the Commercial Registry of Funchal under the unique registration and corporate ID number (NIPC) 517780380, with a share capital of € 5,000.00 (five thousand euros), is responsible for the website www.sailingsensation.com (hereinafter referred to as “website”).
1.1. These General Conditions are intended to regulate the Terms and Conditions governing the contractual relationship between Bússola Dourada – Lda. (hereinafter referred to as “Sailing Sensation”) and its Customer, as identified in the Contract (hereinafter referred to as “Customer”) within the scope of catamaran travel services and complementary activities offered by Sailing Sensation.
1.2. The services provided by Sailing Sensation include catamaran trips, including but not limited to sightseeing tours, onboard meals, private events, and additional activities, as described on the website.
2.1. Reservations for any service can be made through the website or by phone call, with the reservation formalization being the acceptance of these Terms and Conditions.
2.2. Payment must be made at the time of booking, unless otherwise agreed, using a credit card, bank transfer, or other secure methods available on the website.
2.3. Non-payment implies automatic cancellation of the reservation.
2.4. After payment, the Customer will receive a reservation confirmation via email, which must be presented at boarding.
2.5. The Customer may request reservation changes at least 48 (forty-eight) hours in advance, subject to availability and a €50 (fifty) additional fee.
2.6. Changes requested with less than 48 (forty-eight) hours’ notice may be subject to unavailability and loss of the paid amount.
3.1. Sailing Sensation reserves the right to cancel or alter the service due to adverse weather, technical issues, safety reasons, or force majeure, duly justified.
3.2. In these cases, the Customer may choose one of the following compensation options:
3.3. For reservations made by the Customer, the cancellation policy and resulting refunds are as follows:
3.4. Refunds will be processed within up to 7 (seven) business days through the same payment method used by the Customer at the time of reservation.
4.1. The Customer must arrive at the boarding location at least 30 (thirty) minutes before the scheduled trip time. Customer delays may result in reservation loss with no refund entitlement.
4.2. Sailing Sensation is not responsible for delays at departure or during the trip due to factors beyond its control, including but not limited to port congestion, maritime operations, or decisions of competent authorities.
4.3. At boarding, the Customer must carry an identification document along with the reservation confirmation received at payment.
4.4. The Customer agrees to follow all instructions from the crew during the trip.
4.5. The crew’s observation of behaviors considered inappropriate, such as but not limited to physical or verbal aggression, abusive alcohol consumption, or use of illicit substances, will result in the immediate removal of the Customer from the vessel without any refund entitlement.
4.6. Sailing Sensation reserves the right to involve competent authorities if necessary and to demand compensation for any damages caused to the vessel or third parties by inappropriate conduct of the Customer.
5.1. The Customer must inform Sailing Sensation of any medical conditions or special needs that may require specific care during the trip.
5.2. In case of a medical emergency onboard, the crew will administer first aid and, if necessary, call emergency services, with all costs associated with the activation of these services being the responsibility of the Customer.
5.3. The vessel is equipped with all legally required safety devices, including life jackets, emergency boat, and other safety devices, the use of which will be instructed by the crew.
5.4. In case of an onboard emergency, the Customer is obligated to follow all instructions provided by the crew.
5.5. The Customer is prohibited from bringing any dangerous items onto the vessel, including flammable substances, explosives, or any bulky objects that could compromise the safety of the vessel or passengers; Sailing Sensation reserves the right to refuse boarding such items.
6.1. Sailing Sensation will not be liable for delays, cancellations, or itinerary changes due to force majeure, including but not limited to adverse weather conditions, strikes, labor disputes, or other events beyond the reasonable control of Sailing Sensation.
6.2. In the event of any of the situations mentioned above, the Customer may choose to reschedule the trip, receive a full refund of the paid amounts, or be issued a voucher of equivalent value, valid for 6 (six) months.
7.1. Sailing Sensation has civil liability insurance covering physical or material damages occurring during the trip, except where such damages result from negligent acts or inappropriate behavior of the Customer.
7.2. Sailing Sensation is not liable for damages or losses of the Customer's personal belongings during the trip, except when such loss or damage is directly attributable to crew negligence.
8.1. Personal data collected as part of the reservation will be processed in accordance with the General Data Protection Regulation (GDPR) and used exclusively for reservation processing and service provision.
8.2. The Customer has the right to access, rectify, delete, or restrict the processing of their personal data, and may exercise these rights by contacting Sailing Sensation.
8.3. All information relating to personal data collected by Sailing Sensation is duly described in its Privacy Policy.
9.1. The Customer accompanying a child under 12 years old is obligated to supervise them throughout the trip.
9.2. Customers with disabilities must communicate their condition to Sailing Sensation before the trip to ensure all necessary measures are taken for their safety and comfort.
10.1. Sailing Sensation reserves the right to alter or modify these Terms and Conditions at any time without prior notice.
10.2. Changes made will be published on the Sailing Sensation website and will take effect immediately upon publication.
11.1. These Terms and Conditions are governed by Portuguese law.
11.2. For the resolution of any dispute arising from the execution or interpretation of these Terms and Conditions, the Judicial Court of the Madeira District shall have jurisdiction, with express waiver of any other.
